Terms of Service

These Terms of Service ("Terms") govern your use of the SunUp mobile application and website operated by SunUp. By downloading, accessing, or using SunUp, you agree to these Terms.

1. The service

SunUp provides alarm, wake-up dismiss tasks, sleep estimation, and related insights for personal, non-commercial use. Features may change over time as we improve the app.

2. Eligibility

You must be at least 13 years old to use SunUp. If you are under the age of majority in your jurisdiction, you may use SunUp only with permission from a parent or legal guardian.

3. Subscriptions and billing

  • SunUp Pro is offered as an auto-renewing subscription through Apple's App Store
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage or cancel subscriptions in iOS Settings → Apple ID → Subscriptions
  • Free trials, if offered, convert to a paid subscription unless cancelled before the trial ends
  • Refunds are handled by Apple according to App Store policies

4. Acceptable use

You agree not to:

  • Use SunUp in any way that violates applicable law
  • Reverse engineer, decompile, or attempt to extract source code except where permitted by law
  • Interfere with or disrupt the app, servers, or networks connected to the app
  • Use SunUp while driving or in situations where being fully awake is required for safety, unless you can do so safely

5. Health and safety disclaimer

SunUp is a consumer wellness and productivity tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Sleep stage estimates are approximate and for informational purposes only. Do not rely on SunUp for medical decisions. Consult a qualified professional for health concerns.

You are responsible for setting alarms appropriately and ensuring you can safely complete dismiss tasks when waking.

6. Intellectual property

SunUp, including its design, branding, software, and content, is owned by SunUp and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the app.

7. Third-party services

SunUp integrates with Apple services (App Store, StoreKit, notifications, AlarmKit where available) and analytics/attribution services such as AppsFlyer. Your use of those services is also subject to their terms and policies.

8. Disclaimer of warranties

SunUp is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that alarms will always ring, that dismiss tasks will always succeed on the first attempt, or that sleep estimates will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, SunUp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of SunUp. Our total liability for any claim relating to SunUp will not exceed the amount you paid us in the twelve months before the claim, or USD $50 if you have not paid us.

10. Termination

You may stop using SunUp at any time by deleting the app. We may suspend or terminate access if you violate these Terms or if we discontinue the service.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of SunUp after changes become effective constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws applicable in the jurisdiction where SunUp operates, without regard to conflict of law principles.
